Barstow attempted murder case dismissed due to ‘lack of sufficient evidence’ – VVdailypress.com

"There just wasn't enough evidence to proceed with the case," DA's office says.

BARSTOW Two men arrested for their alleged involvement in a shooting in late January have since had their criminal cases dismissed, according to court records.

Criminal charges filed against Alsell Richardson, 25, and Jermaine Stone, 23, both of Barstow, were dismissed in a preliminary hearing held early February.

The charges were dismissed for a lack of sufficient evidence, San Bernardino County District Attorneys office spokesman Christopher Lee said Monday. There just wasnt enough evidence to proceed with the case.

Both men were facing a slew of felony charges including felony counts of attempted murder, attempted armed robbery, and burglary following their reported involvement in a shooting that left two others wounded on Jan. 21.

Richardson told a Daily Press editor last week that he had been wrongly accused and wrongly arrested.

"They caught the wrong guy," Richardson said. "I was sitting in jail for 21 days for something I didn't do.They just said I'm going home (at the preliminary hearing). My lawyer (public defender) said they dropped it."

Barstow Police Department Capt. Andrew Espinoza referred a reporter to the D.A.s office for comment.

Once we submit a case to the District Attorneys Office for review, we generally refrain from commenting on the investigation, Espinoza said in a Monday email.

Espinoza said no other suspects have been arrested. Further details werent provided Monday.

Richardson and Stone have since been released from custody, according to court records, and currently face no charges in connection to the incident, which remains under investigation by the Barstow Police Department.
